By Instructions received from his Excellency the palatine and the rest of the true and absolute Lords and proprietors of the province of Carolina dated att white hall the 5th day of February 1678-9 Remaineing upon Record in the Secretaries office in the County of Albemarle as doth att large appeare, I John Harvey Governr and Lords proprietors Depty being required to passe grants according to the fform by them prescribed to all persons who shall make the same appeare to us & desire the same, yt they had pattents for Land from Sr William Berkeley any time before the 25th day of Decemr 1663 With all im̄unities and priviledges therein granted Bee it knowne unto all men that this 27th day of Novemr 1679. Jno Varnham esqr made appeare to the governor and Lords Deputies A pattent of Land conteineing Two hundred and ffifty acres granted by Sr Willm̄ Berkley the 25th day of Septemr 1663. Remaineing upon record in the Secretaries office above the patent hereunder granted as doth in full appeare upon which I John Harvey Governor and the rest of the Right honble Lords proprietors Deputies as aforesd have passed this following grant. Sr George Carteret Knt & Barontt Vice Chamberlaine of his Majties household one of the Lords of his Matys most honble privie Counsell, palatine of Carolina, & ye rest of the true and absolute Lords & proprietors of Carolina. To all persons to whom these presents shall come, Greeting in our Lord God everlastinge, Know yee that wee the sd Lords & absolute proprietors according to our Instructions dated at White hall ye 5th

day of ffebruary 1678-9 remaineing upon Record in the County of Albemarle in the province of Carolina, Doe hereby grant unto John Varnham esqr of the sd County plantor, a plantac̄on conteineing Two hundred and ffifty acres of Land English measure, lying and being in the precinct of Shaftsbury lying on the River of Albemarle, begininge att a marked Red Oake on the River side by Rodger Williams his Land & running downe the sd River to a marked pine, then Nōr: Nōr: East Three hundred and Twenty pole, then to the Miles end of Roger Williams his Land and soe by his Trees South West to ye first station, the sd Land being due unto the sd John Varnham by & for the transportac̄on of ffive persons into this Collony whose names are in the Record mentioned under this pattent To have and to hold the sd plantac̄on unto the sd Jno Varnham esqr his heires and assignes for ever, with priviledge of hawking, hunting ffishinge & ffowleing, with all woods & trees, wth what else is there standing, growing and being, wth his due share of all Mines & Mineralls, wth all profetts, Comodities & hereditamts whatsoever belonging to ye sd Land Yieldinge and paying therefore unto us & our heirs & Successors yearely every 29th day of Septemr according to the English account for every ffifty Acres of Land hereby granted one shilling of lawfull English money, or the value thereof, for every of the abovesd ffifty acres To bee holden of us in fee & com̄on soccage provided always that if the sd Land bee not seated wth in one yeare after ye date hereof That then this pattent to be void or else to stand in full force. Given at Mr Geo: Durants house under ye Seale of ye Countie of Albemarle this 27th day of Novemr being ye 16th yeare of our possession of our province of Carolina Anō Dōm̄ 1679 Witnes Jno Harvey esqr prsidt and Comandr in chiefe of our sd County, and our trusty and Well beloved Councellors who have hereunto sett their hands ye day & yeare abovesd
