The Honble Edwd Hyde Esqr presented to this Board a Comission from his Excellcy the most noble Henry Duke of Beaufort & Pallatine & ye rest of the true and absolute Lds Proptrs of Carolina under their great Seale bearing Date the 24 day of Janry Ano Dni 1711-12 thereby Constituteing & appointing him ye Said Edwd Hyde Esqr to be Govr Capt Genll Admll Comandr in Chiefe of that part of ye province of Carolina that lyes No & Et of Cape ffeare Called No Carolina which Comission was read published & Ordered to be recorded And then ye said Edwd Hyde Esqr tooke and Subscribed ye Severall Oathes by Law appointed to be taken for his quallification together with ye Oathes for ye due observation of ye Laws of Trade And then tooke place at ye Board pursuant to ye afsd Comission

The Honble the Govr haveing published his Comission as abovesd

It is ordered that a proclamation Doe Issue out in ye following words

(Viz) By the Honble the Governr & Council a proclamac̄on

Whereas the Honble Edwd Hyde Esqr haveing this day duly published a Comission to him directed from his Excellcy the most noble Henry Duke of Beaufort pallatine and ye rest of ye true & absolute Lds proptrs of Carolina under their great Seals bearing Date ye 24th day of Janry Ano Dni 1711-12 thereby appointed him ye Said Edwd Hyde Esqr to be Govr Capt. Genll & Admll of No Carolina and haveing quallifyed himselfe accordingly—

Wee do therefore by this our proclamation Strictly require and Comand all her Matyes Loveing Subjects within this Governmt Governmt to render their Due obedience to our Soveraign Lady ye Queen and ye Governmt as it is Established under her by virty of Of ye afsd Comission And wee doe hereby further Declare all Comissions both millitary and Civill and all process now depending in any of ye Courts of Judicature in this Governmt are and shall stand & be in full force untill farther orders from this Board or from the Honble the Governmt Given under our hands and ye Seale of this Collony this 9th day of May Ano Dni 1712

The Honble Coll Thos Pollock presented to this Board a Deputation under ye hand and Seale of ye right Honble Jno Lord Carteret one of the true and absolute Lds Proptrs of Carolina thereby appointing him ye Said Coll Thos Pollock to be his Deputy in No Carolina which was read allowed of and Ordered to be recorded And then ye said Thos Pollock tooke and Subscribed the Severall Oathes by Law—appointed to be taken for his quallification and tooke his place at ye board accordingly.

The Honble Lieutent Coll Thos Boyd presented to this Board a Deputation undr ye hand and Seale of Sr ffulwar Skipwith Barrt Guardian to ye Right Honble the Ld Craven One of the true and absolute Lds proptrs of Carolina thereby appointing him to be Depty to ye Said Ld Craven And ye same was read allowed of & Ordered to recorded And then ye Said Coll Thos Boyd tooke and subscribed the severall Oathes by Law appointed to be taken for his quallification and tooke his place at ye Board accordingly

Tobias Knight Esqr presented to this Board a Comission from his Excellcy the most noble Henry Duke of Beaufort Palatine and the rest of the true and absolute Lds proptrs of Carolina thereby appointing him ye Said Tobs Knight to be Secty of this Governmt of No Carolina, And another Comission under ye hand and Seale of the Honble Coll Robert Quarry Surveyr Genll of her Matyes Customes in ye Southern district of ye Continent of America thereby appointing him ye Said Tobs Knight to

be Collectr of her Matyes Customes in Corratuck district both which was read allowed of and ordered to be recorded. And then the Said Tobias Knight tooke and subscribed the severall Oathes appointed to be taken for this quallification.

Then this Board adjourned untill to morrow morne 8 of clock


Saturday morne 8 of Clock this Board mett again present ut Supra

The Honble the Govr having Comunicated to this Board a Letter from ye Govr of Virga Conteyneing proposalls made by that Governmt to this for raiseing Stores to Carry on the warr agt ye Indyans It is ye oppinion of this Board that ye Same be Laid before ye Assbly att ye next Session for their Consideration

The Honble Edwd Hyde Esqr haveing published a New Comission for this Governmt it is thought fitt that a proclamation Doe Issue out for dissolveing ye present Assembly in ye following words (viz)

By the Honble the Govr & Councill a proclamation

Whereas this present Assembly stands prorogued by our proclamation to ye 22d day of this Instant may and it being thought fitt for divers weighty reasons that ye same be dissolved Wee doe by this our proclamation Dissolve ye said Assembly and it is hereby dissolved Given under our hands and ye Seale of ye Collony this the 10th day of May Ano Dni 1712

Whereas it dos appeare to this Board by divers concurring Informations that Majr Genll Barnwell has been very remiss in ye Execution of his trust reposed in him by this Governmt agt ye Indyans It is ordered that if upon Examination he bee found Guilty thereof that a representation thereof be drawn up by this Board & that he be Charged therewith before ye Governmt of So Carolina by Som agent to be sent thither for that purpose

This Board takeing into their Consideration ye Eminent danger the Inhabitants of this Government Still lyes undr from ye Indyans especially those of pamlico and Nuse Wherefore it is ordered by this Board that a Commander and thirty men be constantly kept in ye ffort at Cow-Towne called Hyde ffort untill further order and that ten men be constantly kept at ye Garrison at Mr Readings on pampticough as a Barrier and Safeguard to ye Inhabitants on and about those two Rivers and that they observe and ffollow Such Instructions and orders as they shall receive from tyme to tyme from ye Honble ye Governr

This Board takeing to their Serious Consideration ye great want of amunition as well to prosecute ye Warr agt ye Indyans As to maintayn ye Garrisson appointed for a Safe Guard to ye County of Bath and for as much as ye assemble Cannot possible meet tyme enough to Consult of

and Assent to Such Measures as may be thought fitt to suply ye present necessity therein It is Ordered by this board yt Honble the Govor be hereby Impowered to make Such Contracts and Agreemts on behalfe of ye Country wth any person in Virga or elsewhere as he shall think necessary for amunition & that he make report of his proceedings therein to ye next Assbly for their Concurrence thereto—

Upon petition of Jno Hardy showing that a tract of Land formerly Granted to Jno Bird on Kesiah river is Lapsed for want of Seating & pray's that ye Same may be granted to him—

Ordered that ye Said petition be refered to ye next Councill

Upon petition of Edwd & Willm̄ Bird showing that a tract of Land formerly granted to Jno Bird upon Cashoke is lapsed for want of Seateing and pray's ye Same may be granted to them

Ordered the ye Said Land be granted to ye Said petitionrs as pray'd By Order of Govr & Councill
