A Memorial and Remonstrance of two gentlemen of the Council and the Attorney General of North Carolina against Capt. Burrington Govr

Whitehall Tuesday April 3. 1733.

Then were read four papers from Mr Rice and Mr Ashe containing complaints against Capt. Burrington Govr of North Carolina.

Thursday April 5th 1733.

A letter from the Duke of Newcastle dated the 27th of last month signifying his Maj. appointment of Gabriel Johnstone Esqre to be Govr of North Carolina was read And the Secretary laying before the Board the Draught of a Commission accordingly a Representation thereupon and a letter for inclosing the same to the Duke of Newcastle were sign'd.

Thursday May 24th 1733.

Mr Johnstone appointed Govr of North Carolina attending the Board desired he would let them have a state of the blank Warrants for Grants of Land which had been granted by Sir Richard Everard the late Govr of that Province and he promised to perfect the said state as soon as possible.

Tuesday June 19th 1733.

The following copies of Orders in Council were laid before the Board & read

Order in Council of the 10th May 1733 approving the Draught of a Commissn for Gabriel Johnstone Esqre to be Govr of North Carolina

Wednesday June 20th 1733.

The Naval Officers List of ships entered and clear'd at Port Beaufort in North Carolina from Christmas 1730 to Michaelmas 1732 was read.

Tuesday July 17th 1733.

Mr Johnstone appointed Govr of North Carolina attending his Observations upon the Draught of his Instructions were read and the Draught of his general Instructions and of those which relate to the Acts of Trade being agreed The Draught of a Representation thereupon was order'd to be prepared [page 105] which was agreed and sign'd as also a letter for inclosing the same to the Duke of Newcastle on 18th July

Wednesday July 25th 1733.

A Representation from Capt. Burrington Gov. of North Carolina containing the present state and condition of that Province was read and the Papers referred to in the said Representation dated the 1st of Janry 173⅔ was laid before the Board

Wednesday Novr 28th 1733.

The Memorial of Gabriel Johnstone Esqre praying that the Representation of Mr Smith Chief Justice of North Carolina relating to the validity of the laws in that Province may be referred to the Solicitor General for his opinion thereon was read and directions were given for sending a copy of the said Representation to Mr Atty & Mr Solr Genl for their opinion thereupon in point of law.

Tuesday December 11th 1733

The Secretary laying before the Board a letter he had received from the Attorny Genl stating some difficulties with regard to the Memorial of Mr Smith relating to the laws of North Carolina (read 12 July 1732) and sent to Mr Attorny Genl the 28th of the last month the same was read and Directions were given for making an Answer thereto.

Thursday Decr 20th 1733.

Copy of an Order in Council of the 2d Aug. 1733 approving the draught of Instructions for Gabriel Johnstone Esqr Govr of North Carolina was read
