Know all men by these Presents that I William Cocke, of Fincascle County and Colony of Virginia, am held and firmly bound unto Samuel Woods of Amherst County and Colony aforesd in the penal sum of sixteen hundred pounds current money of Virginia, to which payment well and truly to be made I bind myself, my heirs, &c., to the sd Woods, his heirs, &c., firmly by these Presents, Sealed with my Seal and Dated the 15th day of November, 1776.

The Condition of the above Obligation is such that Whereas the sd Cocke hath bargind and sold and by these presents, for and in consideration of Eight hundred Pounds to him the sd Cocke by him the sd Woods in hand payd and stipulated to be payd as hereafter mentioned, doth grant, bargin and sell, alien and confirm unto the sd Woods, his heirs, &c., certain Tracts or parcels of Land lying in or on Holston's River, commonly cald the great or long Island of sd River, and also a Small Tract containing about Sixty acres lying South of sd River oposite to the sd Island, and he the sd Cocke doth warrant to the sd Woods that his the sd Cocke's Right to sd land by Improvement is the Earliest in time, and also doth warrant the sd lands and the title thereof to him the sd Woods against him the sd Cocke, his heirs &c., and all claiming in, by or through him or them.

And Whereas the sd Woods hath payd to the sd Cocke Twelve Pounds Ten Shillings of sd money in hand, & stipulated for the payment of other one hundred and Thirty Seven Pounds Ten Shillings in horse flesh to be delivered at sd Woods' house before the first day of May Next, and also hath Given Bonds for the Remaining six hundred and fifty Pounds at the Rate of fifty Pounds per annum, the first fifty to become due Immediately after the sd Woods shall have Obtained a Title to sd lands from Government, and the Remaining fiftyes annually in succession after Each Other, provided nevertheless that all the Expences, cost and charges that shall accrue to the sd Woods in Obtaining sd Titles Shall be deducted out of the first payment or payments of sd money. Now if the sd Cocke shall perform all and Every article contained in this writing Binding upon him, then the above Obligation to be Void, or Elce to Remain in full force and Virtue.
