                <head type="original" rend="center">THE <name key="name0000352" reg="Executive Committee, Board of Trustees" type="organization" rend="yes">EXECUTIVE COMMITTEE</name> OF THE <name key="name0000107" reg="Board of Trustees" type="organization">TRUSTEES</name> OF THE <name key="name0001146" reg="University of North Carolina" type="organization">UNIVERSITY</name>,<lb/>TO THE<lb/><hi rend="italics">Merchants, Shopkeepers, Traders, and others in <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name></hi>,<lb/><hi rend="italics"><name key="name0000934" reg="Raleigh, NC" type="place">Raleigh</name>, <name key="name0000484" reg="Hillsborough, NC" type="place">Hillsborough</name>, <name key="name0001238" reg="Wilmington, NC" type="place">Wilmington</name> and elsewhere in</hi><lb/><name key="name0000745" reg="North Carolina" type="place">NORTH CAROLINA</name>.</head>
                <p>Early in February 1855 and immediately after the passage of the Revised Statute in relation to the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>, the <name key="pn0001638" reg="Swain, David Lowry" type="person" rend="yes">President</name> prepared a circular which was extensively distributed calling attention to the law, and setting forth the views of the Faculty in relation to it. On the 4th of July last he published a second circular, expressing his individual opinions upon the subject and announcing his determination as a citizen, a trustee and President of the <name key="name0001146" reg="University of North Carolina" type="organization">University</name> to carry the provisions of the law into effect by every means in his power. Copies of both these circulars he delivered personally to the great body of merchants and traders in <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name> and <name key="name0000934" reg="Raleigh, NC" type="place">Raleigh</name>.</p>
                <p>The undersigned learn with deep regret that in various instances, and in some, of the most aggravated character, these warnings have been disregarded, and that men who have heretofore maintained a fair character for integrity, have been concerned in violating a statute passed upon mature deliberation, and at the suggestion of the Trustees for the protection of parents and guardians many of whom reside in distant States and send their sons hither under the confident hope, that in the honest State of <name key="name0000745" reg="North Carolina" type="place">North Carolina</name>, they will be shielded from imposition, and especially from all attempts to seduce them into habits of imprudent and unlawful expenditure.</p>
                <p>Under these circumstances the undersigned find themselves constrained to give notice to the public that there will be a perfect union of all the authorities of the institution, in an honest endeavour to enforce the execution of the law, and to bring down proper punishment upon all those who feel themselves at liberty to violate its provisions.</p>
                <p>They have no hesitation in stating for the consideration of all concerned, that it is in the power of no one, to inflict a greater evil upon the community, than for the sake of unlawful gain, to pursue a course of business calculated to corrupt the morals and undermine the integrity of the youth of the country, and that no honest man can contemplate such conduct without regret and abhorrence.</p>
                <p>The <name key="name0001146" reg="University of North Carolina" type="organization">University</name> is at present in a state of unprecedented prosperity. The course of instruction is more perfect, thorough and systematic than at any previous period; the discipline mild, parental and firm, and general quiet, order and diligence prevail in every department. The Trustees are adopting the most efficient measures, to preserve and increase its usefulness and reputation and have only to ask of those whom they now address earnest co-operation, in the maintainance of measures indispensable to the accomplishment of these noble purposes. This co-operation they are satisfied will in the end, promote the interests of the fair dealer, not less effectually than those of the University.</p>

                <head type="original" rend="center">AN ACT CONCERNING THE <name key="name0001146" reg="University of North Carolina" type="organization">UNIVERSITY</name>.</head>
                    <head type="original" rend="center">CHAPTER 114.</head>
                <p>1. Any license granted to retail spirituous liquor, wine or cordials at <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, or within two miles thereof shall be void.</p>
                <p>2. No person shall erect, keep, maintain or have at <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, or within two mites thereof,<pb id="unc06-148-p02" n="2"/>any tipling house, establishment or place, for the sale of wine, cordials, spirituous or malt liquor.</p>
                <p>3. No person in the State, without permission in writing from the <name key="pn0001638" reg="Swain, David Lowry" type="person">President</name> of the University, or some member of the Faculty, shall sell or offer to sell or deliver to any Student of the University, or to any other person, any cordial, wine, spirituous or malt liquor for the purpose of being used, or with knowledge that the same will be used at <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, or within two miles thereof, by any such Student.</p>
                <p>4. No person, at or within two miles of <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, shall give or furnish any electioneering treat or entertainment.</p>
                <p>5. No person shall set up, keep or maintain at <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, or within five miles thereof, any public billiard table, or other public table of any kind, at which games of chance or skill, by whatever name called, may be played.</p>
                <p>6. No person, without permission in writing obtained therefor from the <name key="pn0001638" reg="Swain, David Lowry" type="person">President</name> of the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>, or some member of its Faculty, seven days beforehand, shall exhibit at <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, or within five miles thereof, any theatricals, sleight of hand or equestrian performances, or any dramatic recitations or representations, or any rope or wire dancing, natural or artificial curiosities, or any concert, serenade or performance in music, singing or dancing.</p>
                <p>7. Any person who shall offend against any of the provisions of this chapter, hereinbefore recited, shall be deemed guilty of a misdemeanor.</p>
                <p>8. Any contract or agreement by any Student of the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>, being then a minor, with any shopkeeper, merchant, trader or other person, upon the sale of any wine, cordial, spirituous or malt liquor, or of any goods, wares or merchandize, or any article of trade, or with the keeper of any livery stable, shall be void, unless the same, if made at or within two miles of <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, be made under the written permission of the <name key="pn0001638" reg="Swain, David Lowry" type="person">President</name> of the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>, or some member of its Faculty; or if made at a greater distance from <name key="name0000165" reg="Chapel Hill, NC" type="place">Chapel Hill</name>, under the written consent of the person who may have the control and authority over such Student.</p>
                <p>9. Every contract made with a Student of the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>, contrary to the provisions of the preceding section, shall be void, and may be avoided on account of any of the matters therein contained, on the plea of the general issue: on the trial whereof, if it appear that the defendant was, at the time of the alleged contract, a Student of the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>, it shall be presumed that he was, at the making thereof a minor.</p>
                <p>10. Every such contract shall be incapable of being confirmed, and any promise or obligation given by such Student, after his arrival at full age shall be void.</p>

                <p>Permit me to request your attention to the accompanying copy of @ Circular which has been addressed to all parents and guardians, who have sons or wards at the <name key="name0001146" reg="University of North Carolina" type="organization">University</name>.</p>
                <p>The duty which I recommend so earnestly to others, will in my own case be considred an imperative obligation, and no one must be permitted to contract @ debt in my name, or on my account, here or elsewhere, without exhibiting specific authority in writing and such authority will be rarely given.</p>
